On July 26, 2013, Attorney General Olens filed a lawsuit against Western Sky Financial, LLC (Western Sky), CashCall, Inc. and Delbert Services Corporation alleging violations of Georgia’s Payday Lending Act.

1. What does the Payday Lending Act prohibit?
The Payday Lending Act, a Georgia law, specifically prohibits the making of unlicensed loans of $3,000.00 or less, including the making of small consumer loans to Georgia residents through the Internet (O.C.G.A. § l6-17-1, et seq).
2. What is the Attorney General asking for in the lawsuit?
Attorney General Olens is asking the court to prohibit Western Sky, CashCall, and Delbert Services from making payday loans in Georgia, to declare all existing loans null and void, and to enjoin the companies from further collection of payments. The lawsuit also seeks civil penalties for violations of the Payday Lending Act.
3. Is there an injunction?
Yes. The court entered an Injunction Order prohibiting the Defendants from making any new loans in Georgia or transferring any existing loans during the pendency of the lawsuit. The Injunction Order does not prohibit the Defendants from collecting payments on existing loans while the lawsuit is pending.
